These terms of service govern your use of our service. This is applicable for the free trial service too. The website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation) and procedures that may be published from time to time on this site by Streambubble.
Kindly read and understand the agreement vigilantly before accessing the website. Even if you are using any specific part of the website, you are bound to the terms and conditions regarding the website. The website can be accessed only if you agree to all the terms and condition of the agreement. The website is available only to individuals who are at least 13 years of age.
The account access
The services is solely for the personal use of the user and thus the agreement sets forth certain terms and conditions that apply to customers, but not other users. User includes Streambubble’s paying customers too. Streambubble may suspend or discontinue any of its features, database or content at any time. Streambubble has got complete authority to change or impose limits upon any features or services or can restrict any user from using any specific feature or all features without any prior notice.
The user should certify that it is legally permitted to use the service and should take the full responsibility for the selection and use of the service. In cases of prohibitions from the law, the agreement has no effect and the right to access the service is cancelled in such jurisdictions. It is the responsibility of the user to obtain and maintain any primary equipment needed to connect to, access the service, without any limitation, modems, hardware, software and long distance or local telephone service. The checking of compatibility of the equipments and the services should be the user’s responsibility.
Delivery Policy
The services of Streambubble will be available through the online site. Customers can buy and access the services of Streambubble through www.streambubble.com .“Streambubble will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE”.
Controls
User shall not, nor permit anyone else to, directly or indirectly: (i) reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or underlying algorithms of all or any part of the Service (except that this restriction shall not apply to the limited extent restrictions on reverse engineering are prohibited by applicable local law); (ii) modify or create derivatives of any part of the Service; (iii) rent, lease, or use the Service for timesharing or service bureau purposes; or (iv) remove or obscure any proprietary notices on the Service. As between the parties, Company shall own all title, ownership rights, and intellectual property rights in and to the Service, and any copies or portions thereof.
User shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Service or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Service or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Service. Streambubble reserves the right to bar any such activity.
User shall not attempt to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service or to any Streambubble server, or to any of the services offered on or through the Service, by hacking, password “mining”, or any other illegitimate means.
User shall not probe, scan or test the vulnerability of the Service or any network connected to the Service, nor breach the security or authentication measures on the Service or any network connected to the Service.
User shall not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Service or Streambubble’s systems or networks, or any systems or networks connected to the Service or to Streambubble.
User shall not use any device, software or routine to interfere or attempt to interfere with the proper working of the Service or any transaction being conducted on the Service, or with any other person’s use of the Service.
User shall not use the Service or any Content for any purpose that is unlawful or prohibited by this Agreement.
Payments
The four different payment schemes available in the Streambubble website. By selecting a service, you agree to pay Streambubble the monthly or annual subscription fees indicated for that service. Payments will be charged on the day you sign up for a service and will cover the use of that service for a monthly or annual period as indicated. These service fees are not refundable.
Refund / Return policy
For queries regarding the refund or return of service, customers can contact the support desk of Streambubble available in the website. No refunds or returns will be provided for the plan downgrades, partial months of service or for unused time. You won’t be subject to any kind of refund if you close your account before the end of your subscription period.Your contents, features, or account capacity will be lost when you downgrade your account.
Cancellation and Replacement Policy
If a customer has wrongly chosen a service, he himself has the full authority to change or cancel his service through online. If you do not cancel the subscription before the subscription expiry period, we will automatically renew the subscription according to your renewal cycle. To avoid this automatic renewal, you have to cancel the subscription at least 3 days before the expiry date. You can cancel the subscription through the Billing page in Streambubble. This will prevent further payments.
Methods of Payment
We accept payments online using all major credit cards and in Cheque in AED as well as Dollars. The logos of the accepted cards are mentioned on the Home page and on the Payment check out page.
Registration-security
For easy and hassle free access to the product and services, users have to register with Streambubble and setup a password. Users shall provide accurate, complete and precise information regarding the registration. If a user fails to do so, it shall be seen as a violation of the agreement which may result in the immediate termination of the user’s account. It is the duty of the user to maintain the confidentiality of the user’s Streambubble password and account information.
Termination
Streambubble can terminate the user’s access to all or any part of the website at any time, with or without cause, with or without notice, effective immediately. If the user wants to terminate the agreement or the Streambubble account, you can simply discontinue using the Website. Notwithstanding the foregoing, if you have a paid account, such account can only be terminated by Streambubble if you materially breach this agreement and fail to cure such breach within thirty (30) days from Streambubble’s notice to you thereof; provided that, Streambubble can terminate the website immediately as part of a general shut down of our service. All provisions of this agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Content
All the contents published or delivered via the service or product are protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. Streambubble does not support the distribution and promotion of pornographic content. The user agrees not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works of materials or contents.
Changes
Streambubble is the final authority to make changes or modifications in any part of this agreement. It is the duty of the user to check whether Streambubble has made any periodical changes. It will be presumed that the user agrees to all the periodical changes made in the agreement as long as you continue using the website. As a part of the upgradation process, Streambubble may include some new features, services, tools etc through the website and these services will naturally be a part of the Terms and Conditions of the Agreement.
Warranties
Streambubble provides the warranty to customer. Customer represents and warrants that, 1. with respect to all information it provides to Streambubble, customer has the full right and authority to make such provision and to allow Streambubble to use such information to provide the service, 2. none of the content transmitted, uploaded or otherwise distributed through use of the service will infringe or otherwise conflict with the rights of any third party.
Warranty disclaimer
The information on the website is provided on an “as is” basis. Streambubble and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Streambubble or any of its suppliers and licensors cannot provide warranty that the website will be error free or that the access to the website will be always uninterrupted. The contents or the informations are downloaded and used from our website at your own risk and
Security
In no event will Streambubble, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Streambubble under this agreement during the twelve (12) month period prior to the cause of action. No liability shall be induced on Streambubble because of any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
General representation and warranty
You represent and warrant that
- your website use will be in strict accordance with the privacy policies of Streambubble, with this agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state or other governmental area, regarding online conduct and acceptable content, including all applicable laws regarding the transmission of technical data exported from any place or the country in which you reside) and
- Your website usage will not infringe or misappropriate the intellectual property rights of any third party.
Privacy
All the privacy policies of Streambubble are available in the website under the heading “Privacy Policy” and the users should review it closely.
Copyright
The texts, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software included in the site is the property of Streambubble or its content suppliers and are protected by international copyright laws.
Indemnification
The user hereby agrees to indemnify and hold harmless Streambubble, its licensors, its contractors, and their respective directors, officers, employers and agefrom and against any and all claims and expenses, including attorney’s fees, arising out of your website usage, including but not limited to out of your violation of this Agreement.
